Attorney Elizabeth Boratto Wins Arbitration In Allergy Case
A few weeks ago, Ms. Boratto received a not guilty verdict for her client following an arbitration in DuPage County. Ms. Boratto represented the defendant, a restaurant located in Elmhurst, Illinois. The plaintiff filed a negligence suit against the defendant restaurant claiming he experienced a severe allergic reaction after coming in contact with almonds while dining at the restaurant. The plaintiff was seeking damages in the amount of $50,000.00.
Of significance, Ms. Boratto was able to use the testimony of plaintiff’s own doctor in support of her defense that the restaurant’s alleged conduct did not cause the allergic reaction. It is incredibly rare for a treating doctor to offer favorable testimony for a defendant. This testimony was crucial in securing the not guilty verdict.
